1. About These Terms

1.1 These Terms & Conditions ("Terms") govern all bookings made with Go Trawhale by Pla ("Go Trawhale", "we", "us"), a Thailand-based tour operator, TAT License 21/01368, registered address 57/44 Moo3, Tambon Buak-khang, Sankamphaeng, Chiang Mai 50130, Thailand.

1.2 These Terms apply to all travel packages, itineraries, and services offered by Go Trawhale, whether now existing or introduced in the future.

1.3 These Terms apply to all clients, whether booking directly with Go Trawhale through any channel (including but not limited to our website, email, LINE, WhatsApp, or phone) — or through a trade partner/travel agent acting on their behalf ("Client"). Where a booking is made through a trade partner, both the Client and the trade partner are bound by these Terms as applicable to their respective roles.

2. Pricing & Currency

2.1 All package rates are quoted in US Dollars (USD), calculated at a reference exchange rate of 1 USD = 32 THB unless otherwise stated.

2.2 Rates are subject to reconfirmation at the time of booking. Go Trawhale reserves the right to adjust final invoiced amounts if the THB/USD exchange rate fluctuates significantly between quotation and full payment.

2.3 Quoted package prices are land-only unless stated otherwise, and exclude international airfare, travel insurance, gratuities, and personal expenses.

3. Payment Terms

3.1 Bookings are confirmed on a three-installment schedule:

  • (a) Deposit — 30% of total package value, due at booking confirmation. This deposit is non-refundable.
  • (b) Second Payment — 35% of total package value, due 60 days before departure.
  • (c) Final Payment — the remaining 35%, due 30 days before departure.

3.2 Failure to remit any payment by its due date may result in cancellation of the booking under Section 4 below.

3.3 Accepted payment methods are bank wire transfer (T/T) and major credit cards (Visa, Mastercard). A processing fee of 3–4% applies to credit card payments to cover international transaction costs.

4. Cancellation Policy

4.1 Cancellations made more than 60 days before departure: the 30% deposit is forfeited in full and is non-refundable.

4.2 Cancellations made 31–60 days before departure: the deposit (30%) remains non-refundable. The Second Payment (35%) will be refunded in full, less any actual non-recoverable costs already committed to suppliers on the Client's behalf as of the cancellation date, including but not limited to: domestic airfare payments issued, vehicle/transportation deposits, and boat/marine transport deposits. No additional administrative fee applies beyond these actual, itemized costs.

4.3 Cancellations made within 30 days of departure: all payments made (100%) are non-refundable.

4.4 Approved refunds will be processed within 30 business days of written confirmation of cancellation.

5. Postponement / Date Change Policy

5.1 Date change requests submitted at least 30 days before the original departure date will not be treated as a cancellation. All payments made to date will be credited in full toward the new travel date, subject to supplier availability.

5.2 Credit issued under this section is valid for 12 months from the original departure date. Credit not applied within this period is forfeited.

5.3 Any airline change fees, fare differences, or supplier rate differences (including seasonal pricing variations) for the new date are the Client's responsibility.

5.4 One date change is permitted per booking. A second date-change request will be treated as a cancellation under Section 4.

5.5 Requests made within 30 days of the original departure date are subject to supplier availability and may incur additional costs, assessed case-by-case.

6. Inclusions & Exclusions

6.1 Each package's specific inclusions (accommodation, meals, transport, guide, and listed activities) are set out in the relevant itinerary document provided at time of quotation.

6.2 Unless explicitly listed as included, the following are always excluded: international airfare, comprehensive travel insurance (including trip cancellation, baggage, flight delay, and medical evacuation coverage), visa fees, gratuities/tips, alcoholic beverages, spa or optional activities not named in the itinerary, and personal expenses. Clients are strongly encouraged to purchase separate travel insurance to cover these risks.

6.3 On designated free/rest days, meals not explicitly stated as included are on the Client's own account.

6.4 All packages include complimentary personal accident and food poisoning medical expense coverage, underwritten by Go Trawhale's appointed insurance provider, for the duration of the trip:

  • (a) Accidental injury — medical expenses covered up to THB 500,000 per person.
  • (b) Food poisoning — medical expenses covered up to THB 100,000 per person.

This coverage is subject to the full terms, conditions, and exclusions of the insurance policy, a copy of which is available on request. This complimentary coverage is separate from, and does not replace, comprehensive travel insurance (see Section 6.2) — it does not cover trip cancellation, baggage loss, flight delays, medical evacuation, or repatriation.

7. Single Traveler & Child Policy

7.1 Single supplement rates vary by package, season, and itinerary, and are quoted individually at the time of booking. For packages that include a health screening component, an additional single supplement of +$860 net per person applies.

7.2 Child rates (ages 2–11) and infant rates (under 2) are available on request and vary by package and room configuration (with/without extra bed). For packages that include a health screening component, this component is excluded for children, as it is designed for adults.

7.3 Children under 12 are not recommended to participate in the health screening component of any applicable package.

8. Force Majeure, Weather & Itinerary Changes

8.1 This Section applies to circumstances of force majeure — events beyond the reasonable control of either Go Trawhale or the Client, occurring without the fault of either party. This includes, without limitation, weather conditions, sea conditions, monsoon season closures, government advisories, natural disasters, civil unrest, strikes, government action, or pandemic-related restrictions.

8.2 Where such circumstances arise, Go Trawhale reserves the right to modify, substitute, or reorder any element of the itinerary — including but not limited to boat excursions, island visits, and outdoor activities — as reasonably necessary.

8.3 Where an itinerary element cannot be delivered as originally described due to force majeure, Go Trawhale will make reasonable efforts to substitute an alternative experience of comparable value. Such substitutions do not, on their own, constitute grounds for a refund.

8.4 As force majeure events are beyond the control of, and without fault by, either party, neither Go Trawhale nor the Client shall be liable to the other for any delay, cancellation, or loss directly resulting from such events.

8.5 In the event a trip cannot proceed due to force majeure: (a) any payments not yet committed to suppliers will be refunded in cash; (b) any payments already committed to suppliers and non-recoverable by Go Trawhale will be issued as a travel credit valid for 24 months, redeemable against any future Go Trawhale booking. Go Trawhale will make reasonable efforts to recover funds from affected suppliers on the Client's behalf, and will pass through any amounts successfully recovered.

9. Health Screening Packages — Health & Medical Disclaimer

This section applies to any Go Trawhale package that includes a health screening or medical check-up component.

9.1 The health screening included in such packages is conducted directly by an independent healthcare facility accredited to Joint Commission International (JCI) standards. Go Trawhale is a booking facilitator for this service only and does not provide medical care, diagnosis, or treatment.

9.2 Go Trawhale does not collect, store, process, or have access to any client health data, medical records, or screening results. All medical information is held solely between the Client and the facility, under the facility's own consent and privacy procedures.

9.3 The health screening is not a substitute for regular care from the Client's personal physician. Clients with pre-existing medical conditions should consult their own doctor before participating.

9.4 Go Trawhale is not liable for any medical outcome, diagnosis, or advice provided by the facility or its practitioners. Any concerns regarding the medical service should be directed to the facility directly.

10. Traveler Responsibilities

10.1 Clients are responsible for ensuring their passport is valid for at least 6 months beyond the travel dates, and for obtaining any required visas.

10.2 Clients participating in physical activities (e.g. kayaking, trekking, forest bathing) confirm they are in adequate health to do so. Clients with health or mobility concerns should notify Go Trawhale in advance so appropriate arrangements can be considered.

10.3 Clients must inform Go Trawhale in writing of any food allergies, dietary restrictions, or food-related medical conditions at the time of booking, or as soon as such information becomes known. Go Trawhale and its partner restaurants/hosts will make reasonable efforts to accommodate disclosed allergies and dietary needs, but cannot guarantee an allergen-free environment. Go Trawhale is not liable for any allergic reaction or adverse effect arising from an allergy or dietary restriction that was not disclosed in advance.

11. Transportation & Safety

11.1 All vehicles used are maintained in good working order, appropriately registered and insured. Water transport is provided with life jackets for all guests.

11.2 Go Trawhale is not responsible for delays or missed connections arising from transport arranged independently by the Client.

12. Limitation of Liability

12.1 Go Trawhale acts as an intermediary between the Client and third-party suppliers (hotels, airlines, boat operators, healthcare facilities, and other service providers). Go Trawhale's liability for any third-party service is limited to the extent permitted by applicable law.

12.2 To the maximum extent permitted by law, Go Trawhale's total liability for any claim arising from a booking shall not exceed the total amount paid by the Client for that booking.

13. Complaints Procedure

13.1 Any concerns arising during the trip should be raised with the accompanying guide or Go Trawhale's emergency contact immediately, so they may be addressed in real time.

13.2 Formal complaints not resolved on-trip should be submitted in writing to info@gotrawhale.com within 14 days of the trip's completion.

14. Photography & Media

14.1 By traveling with Go Trawhale, guests agree that photographs or videos taken during the trip may be used for Go Trawhale's marketing and promotional materials, unless the guest notifies us in writing prior to departure that they wish to opt out.

15. Governing Law & Jurisdiction

15.1 These Terms are governed by the laws of Thailand. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Chiang Mai, Thailand.

16. Amendments

16.1 Go Trawhale may update these Terms from time to time. Each update will be reflected by a revised "Last updated" date at the top of this document. The version in effect at the time of booking confirmation applies to that booking.

16.2 If any provision of these Terms is found unenforceable under applicable law, the remaining provisions continue in full force and effect.
